§ T.3Tools · Trademark search

Look before you print anything.

Prepared links to the main trademark registers and company registries for one name, and a checklist for reading the results. This is a search helper. It is not legal clearance.

Prepare the searches

Not legal clearance

This page prepares searches. It does not run them, see the results or tell you whether you may use a name. A free domain, an empty search and a clean-looking register are all reasons to keep checking, not to stop. For a name you will build on, have a trademark attorney clear it.

What to look for in the results

  1. 1

    Same class

Marks are registered per class of goods and services. An identical name in a different class may not conflict. An identical name in yours, or a neighbouring one, usually does.

  2. 2

    Similar sound

Search how the name is said, not only how it is spelled. Kleen and Clean are the same mark to a listener. The spellings below are the likely ones.

  3. 3

    Similar meaning

A translation or synonym can conflict too: Sunrise and Dawn, or the same word in another language. Try the obvious ones.

  4. 4

    Pending and lapsed

Applications that are still pending count. A lapsed registration can often be revived, so note who held it.

  5. 5

    Your market

Check the countries you will sell in, plus the register of any country you manufacture in. A US result says little about the UK.

§ T.3.1How it works

Three steps, no sign-up.

  1. Step 01

    Enter the name

We prepare the searches and list the spellings a listener might use, because a sound-alike can conflict as surely as an exact match.

  2. Step 02

    Open each search

The company-registry and web searches open with your name filled in. The trademark registers do not accept a name in the link, so copy it first and paste it into their search box.

  3. Step 03

    Read the results

Look for the same name in your class of goods, similar sounds, similar meanings and pending applications. Write down what you find and who holds it.

§ T.3.2Inquiries

Fair questions.

Q.01Does this tell me whether I can use the name?
No. It sends you to the public registers and tells you what to look for. We do not search them for you, we do not see the results, and nothing here is legal advice. For a name you will build a business on, have a trademark attorney run a proper clearance search.
Q.02Why do the trademark registers not open with my name filled in?
They are single-page apps with no stable address for a search, so a prepared link would open an empty box or break when they update. Opening the register and pasting the name is slower but honest. Companies House, OpenCorporates and the web searches do take the name in the link.
Q.03What does "same class" mean?
Trademarks are registered for classes of goods and services under the international Nice classification, such as 25 for clothing or 43 for restaurants. The same name in an unrelated class may sit alongside yours. The same name in your class, or a closely related one, usually will not.
Q.04I found nothing. Am I clear?
Not necessarily. Unregistered use can still give someone rights, registers lag behind filings, and a search by name misses logos and sound-alikes. No results means keep going, not stop.
